These Terms govern your use of the BeForAll mobile application and related marketplace services.

Marketplace notice: BeForAll is a curated online marketplace operated by Adamos Kyriakou under the registered business name BFALL MARKETPLACE. Products are sold by approved third-party Sellers. Unless expressly stated otherwise, BeForAll is not the seller, manufacturer, stockholder or shipper of those Products.

1. Introduction and Operator

BeForAll (“BeForAll”, “we”, “our”, or “us”) provides a curated marketplace through which Buyers can discover and purchase Products offered by approved third-party Sellers.

The BeForAll platform is operated by Adamos Kyriakou under the registered business name BFALL MARKETPLACE. Contact details are provided below.

By creating an account, applying to sell, browsing, placing an Order, or otherwise using BeForAll, you agree to these Terms and the policies incorporated into them.

3. Accounts

Certain features require an account. Authentication may be provided through AWS Cognito or supported sign-in providers. Users must provide accurate information, protect their credentials and promptly report suspected unauthorised access.

4. Marketplace Model and Contract of Sale

BeForAll is a curated intermediary marketplace. Sellers must apply and be approved before receiving selling access, and Listings may be reviewed before publication.

The contract for the sale of a Product is between the Buyer and the relevant Seller. Unless BeForAll expressly identifies itself as the Seller for a particular Product, BeForAll is not the seller of that Product.

BeForAll does not ordinarily manufacture, own, store, package, physically inspect, ship or deliver Products and does not operate a return warehouse. Review of Listings does not transfer the Seller’s legal responsibilities to BeForAll.

5. Private and Professional Sellers

Sellers must accurately declare whether they are Private or Professional and update BeForAll if their status changes. BeForAll may request evidence or review a Seller where activity indicates professional selling despite a private declaration.

The App may display Seller status because Buyer rights can differ depending on whether the Seller is private or professional.

Professional Sellers must provide legally required identity, address, contact, registration, tax, VAT and product-safety information where applicable. Each Seller remains responsible for their own tax, VAT, invoicing, accounting and reporting obligations.

6. Seller Responsibilities

Sellers are responsible for accurate and lawful Product information, prices, stock, sizes, materials, warnings, fulfilment and customer information required by law. Sellers must ensure Products are genuine, lawfully supplied, safe, not counterfeit or stolen, and do not infringe third-party rights.

Professional Sellers remain responsible for mandatory consumer rights applicable to their sales, including withdrawal rights, conformity remedies and legal guarantees where applicable.

7. Product Listings and Safety

Listings must be accurate and may be reviewed by BeForAll. Where product-safety law applies, Sellers must provide required Product identification, manufacturer information, responsible economic-operator information and relevant warnings or safety instructions.

BeForAll may remove, restrict or suspend unsafe, recalled, illegal or non-compliant Products and may cooperate with competent authorities.

8. Orders

Orders may remain subject to payment confirmation, stock availability, fraud and security checks, fulfilment capability and legal requirements. An Order may be cancelled or refunded where required by the applicable policy or law.

9. Payments, Buyer Protection and Seller Payouts

Payments are processed through Stripe Connect or another notified payment provider. BeForAll does not store complete card numbers or card security codes on its own systems.

BeForAll may retain an agreed marketplace commission or service fee. Seller settlement or payout may be delayed during Buyer Protection, a return, refund, exchange, dispute, chargeback, fraud review or payment-provider review.

Buyer Protection is a contractual marketplace process and does not make BeForAll a bank or payment institution. Regulated payment services are provided by the applicable payment provider.

10. Shipping, Tracking and Delivery

Sellers are responsible for physical dispatch and delivery. Tracking information may be supplied by Sellers, couriers or third-party tracking providers such as 17TRACK.

BeForAll may use verified tracking events to update Order status automatically. A verified delivery event may start a Buyer Protection period or another settlement step shown in the App.

Tracking data can occasionally be delayed or wrong. BeForAll may investigate disputes, request evidence or correct an automated status where reasonably necessary.

11. Returns, Exchanges and Refunds

BeForAll provides a 14-day return window for eligible physical Products purchased through the marketplace, subject to the Refund Policy and applicable exclusions.

For Professional Seller purchases, this does not reduce any statutory withdrawal right or other mandatory consumer right. For Private Seller purchases, EU trader-to-consumer withdrawal rights do not normally apply, but approved Private Sellers agree contractually to BeForAll’s 14-day return framework for eligible Products.

Returns are sent to the Seller’s approved return destination, not to BeForAll. The App may require valid return tracking.

Verified return or replacement tracking may automatically advance refund or exchange workflows, subject to fraud, error and dispute controls. A size exchange does not itself create a refund unless a refund separately becomes due.

13. Reports, Moderation and Safety Action

Users may report Products, Sellers, users, messages or other content through available reporting channels. BeForAll may review reports and take proportionate action, including requesting information, restricting visibility, removing Listings, cancelling affected transactions or suspending accounts.

14. Privacy and Data Protection

BeForAll processes personal data in accordance with its Privacy Policy, including account, profile, Seller, Order, shipping, tracking, return, payment-reference, messaging, moderation, security and uploaded-image information.

15. Suspension and Termination

BeForAll may proportionately restrict, suspend or terminate accounts, Listings or marketplace actions where reasonably necessary for fraud prevention, safety, legal compliance, payment-provider requirements, repeated Seller failures or serious breaches of these Terms.

16. Liability

BeForAll provides an intermediary marketplace and does not ordinarily control the physical manufacture, storage, packaging or courier delivery of Products sold by third-party Sellers.

Nothing in these Terms excludes or limits liability where doing so would be unlawful or removes mandatory rights or remedies that cannot legally be waived.

17. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Cyprus, without depriving consumers of mandatory protections that apply under the law of their country of residence where applicable.

19. Changes to These Terms

BeForAll may update these Terms to reflect changes in law, platform features, payment providers, marketplace operations or safety requirements. Material changes will be communicated where required. Where law requires fresh consent, BeForAll will request it.
